Terms of Service

1. Acceptance of terms

By creating an account and using AutoLead365 ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. Description of the service

AutoLead365 is a software tool (SaaS) that helps marketing agencies and freelancers find potential business clients through publicly available data (OpenStreetMap, Geoapify, and similar sources), and send outreach emails through the user's own SMTP configuration.

The dashboard is operated through an AI chat assistant. Instead of separate forms and buttons, you type what you want in plain language, and the assistant (powered by Anthropic's Claude AI) interprets your request and carries out the corresponding action on your account - starting a search, generating a demo website, sending a campaign, or managing your autopilot settings. The assistant only acts within your account's plan limits and only performs actions you've asked for; it reports back in the chat what it did.

3. Your responsibility as a user

You are solely responsible for:

• The content of the emails you send through the Service
• Complying with applicable email marketing laws in the countries you send to (e.g. CAN-SPAM in the US, GDPR/ePrivacy in the EU) - including an unsubscribe mechanism where required
• The accuracy of the data you enter (SMTP credentials, email content)
• Using the Service for spam, fraud, harassment, or any illegal activity is prohibited

AutoLead365 reserves the right to suspend or terminate the account of a user who violates these rules, without compensation.

4. Data accuracy

Business data (names, addresses, email addresses, phone numbers) is collected from publicly available sources and AI-generated estimates (lead score). We do not guarantee its complete accuracy or timeliness. AI-generated email texts and demo websites (Studio plan) are examples/suggestions - it is your responsibility to review them before sending/sharing.

5. Plans and billing

The Service offers multiple pricing plans (Free, Premium, Ultra Premium, Studio) with different monthly limits. Paid plans are billed monthly, in advance, through our payment processor Whop (whop.com). Paid subscriptions renew automatically every month until you cancel. You can cancel at any time from your Whop account or purchase page; your plan then stays active until the end of the current paid period and no further charges are made. 6. Limitation of liability

The Service is provided "as is", without warranties. AutoLead365 is not liable for:

• Damage arising from your use of the contacts found or the emails sent
• Interruptions in the operation of third-party services (Geoapify, Anthropic AI, Whop, SMTP providers) that affect functionality
• Indirect, incidental, or consequential damage from using the Service

7. Account termination

You may delete your account at any time. We may suspend or delete accounts that violate these terms, including misuse for spam or illegal activities.

8. Changes to these terms

We may update these terms from time to time. Significant changes will be posted on this page with an updated date.

10. Eligibility

You must be at least 18 years old and use the Service for business purposes only. The Service is not intended for consumers or for anyone under 18.

11. Acceptable use and anti-spam laws

You are the sender of every email you send through the Service and are solely responsible for complying with the laws that apply to it, including CAN-SPAM (US), GDPR and ePrivacy (EU), CASL (Canada), UK PECR, the Australian Spam Act and the German UWG. Some countries require prior consent even for business-to-business email. You must:

• Include your real postal address in every email
• Honour unsubscribe requests promptly
• Not use deceptive headers, sender names or subject lines
• Not send to regions where you do not have a lawful basis to do so

Automatic block. Because local law requires the recipient's prior consent for unsolicited email (even B2B) in Germany, Austria, Switzerland, Italy, North Macedonia, Israel, South Korea and the United Arab Emirates, AutoLead365 finds and shows businesses in those countries but never sends cold email to them, and this cannot be overridden. Use the phone, a contact form or your own opt-in list instead. Other countries have conditions too (for example UK sole traders and Canada's CASL); the sender remains responsible for them.

Emails must not be sent through email providers that forbid cold outreach (for example Brevo's policy requires prior opt-in consent). Check your provider's acceptable-use policy before you send.

12. Data sources and accuracy

Business data comes from OpenStreetMap contributors (ODbL), Geoapify and publicly available business websites. AutoLead365 is not affiliated with, endorsed by or connected to any business that appears in search results.

13. Demo websites

Demo websites generated by the Service are concept designs. They are not the official websites of the businesses shown, and any trademarks, names or logos belong to their respective owners. A business owner can request removal of a demo at any time by emailing matej@autolead365.com.

14. Copyright and takedown (DMCA)

If you believe content on the Service infringes your copyright, send a notice to matej@autolead365.com identifying the work and the material, with your contact details. We will review it and remove infringing material where appropriate. Registration of a designated DMCA agent is pending.

15. Governing law and operator

The Service is operated by Matej Spirovski, North Macedonia. Governing law and jurisdiction: [to be specified - placeholder pending legal review].
